Terms of Service

Photonza is a web application operated by Ali Mert Güleç that collects the photos and videos of an event in one shared feed, lets guests find their own photos with AI face recognition and lets them download content. It runs in the browser; no app-store download is needed.

By creating an account you accept these terms. If you do not accept them, do not create an account.

• Organizer: the venue, event company, school, institution or photographer who creates the event, shares the invite code, manages content and sets the event settings.
• Photographer: a professional who connects to the event with a single-use invite code generated by the organizer, uploads in bulk and sets download and watermark options for their own photos.
• Guest: a person who joins the event with a QR code or invite code. No account is needed; guests are covered by the Guest Participation Agreement.

The information you provide must be accurate and you must keep your password confidential. You are responsible for actions taken with your account. You must be at least 18 years old to create an account.

The event invite code and PIN grant access to that event. Share them only with the people you want to invite. The photographer invite code is single-use and expires 72 hours after it is generated.

You must own the rights to the content you upload, and the people shown must have no objection to sharing.

• Content that is illegal, obscene, violent, hateful or infringing on others' rights may not be uploaded.
• The following are also prohibited: (i) any material relating to the sexual abuse of children; (ii) sharing a person's image in a degrading way without their consent; (iii) circumventing, or attempting to circumvent, watermarks or download restrictions; (iv) automated data collection (scraping), bulk-download software and reverse engineering; (v) impersonating another person, organisation or Photonza; (vi) using face matching to identify or track people.
• For content uploaded by users, Photonza is a hosting provider within the meaning of Turkish Law No. 5651; it is not obliged to review content in advance, reviews infringements reported to it and removes unlawful content. Notice procedure: photonza.com/content-removal.
• The organizer may remove any content in their event.
• In case of a breach we reserve the right to remove content and restrict access; suspension of accounts and events is governed by Section 12.

You keep the copyright in the content you upload. You grant us only the licence needed to provide the service, limited to the event and the retention period. We do not use your content for marketing.

Watermarks and download restrictions may apply to photos uploaded by the photographer. In that case guests can view but not download the photo.

Photo sales: guests see a "Buy" option on photos the photographer uploaded with a watermarked preview, and purchase requests reach Photonza. The sale price, revenue share and delivery method are agreed separately in writing (including by email) between the photographer and Photonza; no sale is completed without that agreement. For each photo sold this way the photographer grants Photonza the right to deliver the unwatermarked digital copy to the buyer, and grants the buyer only the right to reproduce it for personal, non-commercial use (the rights granted are listed separately here as required by Article 52 of Turkish Law No. 5846). The photographer keeps the copyright. For consumer buyers the Pre-Contract Information Form and Distance Service Contract apply.

For the collection and sharing of the photos, videos and notes uploaded to your event you are the data controller within the meaning of KVKK (and the GDPR); Photonza is the processor that stores and displays this content on your behalf. This section serves as the processor agreement under Article 12 of KVKK and Article 28 of the GDPR.

• Photonza processes event content only to provide the service (storage, resizing, display in the feed, downloads) and on your instructions; it uses it for no other purpose. Processing for face matching is governed separately below.
• Photonza uses the sub-processors listed in the Privacy Policy (Supabase, Cloudflare, Vercel), notifies account holders at least 30 days before a new sub-processor is added and gives them the opportunity to object. These sub-processors are established abroad or provide their services on infrastructure abroad; the organizer instructs that event content be stored on this infrastructure. For these transfers Photonza relies on the Board's standard contract (processor to processor) under Article 9 of KVKK; completing the contracts and notifying them to the Board is in progress.
• Photonza applies the technical and organisational measures in Section 8 of the Privacy Policy and informs you without undue delay when it becomes aware of a data breach.
• Event content is deleted automatically 30 days after the event ends. You may delete or download content at any time within that period.
• We answer guests' requests regarding event content (deletion, access) in cooperation with you and within the statutory period.
• Your obligations: (a) inform attendees that photos and videos are taken at the event, that they are shared in the Photonza feed and, if face recognition is on, that the faces in photos are scanned for matching with consenting guests; to do so, display the notice at photonza.com/organizer-notice, or a notice containing the same information, at the event entrance where attendees can see it; (b) upload to the event only photos and videos you have the right to upload and share; (c) obtain the required parental consent for photos of children (Photonza may ask the organizer for an explanation or documents regarding parental consent following a complaint or where it finds that children feature heavily in the event; if they are not provided within a reasonable time, it may remove the content concerned and turn face recognition off for the event); (d) share the invite code only with invitees; (e) turn face recognition off in the event settings at events where most participants are children, and at any other event where you consider it unsuitable for your participants; (f) forward to Photonza without delay any objection or deletion request concerning face signatures that reaches you. When creating each event you additionally confirm the obligations in (a) and (b) with a separate, mandatory commitment checkbox ("Organizer commitment"); your confirmation is recorded together with the event, the date and the version of the commitment text. In the same step you also accept the current version of these Terms with a separate, mandatory checkbox; that acceptance is likewise recorded with the event and the version.

The photographer assumes in their own name, for the content they upload, the obligations in (b) and (c) of this section and the indemnity clause below; the organizer informs the photographer they invite about these Terms.

Indemnity and recourse: the organizer holds Photonza harmless against any claim, administrative fine, compensation and litigation costs, including reasonable attorney's fees, brought against Photonza because of the organizer's breach of its obligations in this section (informing attendees, rights in uploaded content, parental consent for children); Photonza has recourse against the organizer for amounts it is obliged to pay. Photonza notifies the organizer of the claim within a reasonable time. If the organizer is a consumer, this clause applies only in proportion to their fault.

Allocation of roles: Photonza determines the purpose and means of the "Find Me" face-matching processing (face signatures generated from guests' selfies, detection of faces in event photos and videos, momentary computation and comparison of signatures, and storage of matching signatures); Photonza is therefore the data controller for that processing, and it is not subject to the processor terms above. The organizer can turn face recognition off for their event and has no access to face signatures.

Face recognition is optional for guests and works only when the guest gives a separate explicit consent; guests can access the event gallery without using it. The organizer can turn the feature off for the whole event.

While the feature is on, the faces in photos and videos uploaded to the event (including people who appear in photos and do not use the feature) are detected; the position of each face and a small face crop are kept with the photo. Face signatures are computed momentarily solely for matching with consenting guests; only the signatures of faces that resemble a consenting guest are stored, the others are discarded without being stored. This data is not linked to names and is deleted with the event. Details and the objection route are in Section 4 of the Privacy Policy.

Face matching is statistical and not perfect. Some photos may not be found or people who look alike may be suggested. Results are therefore shown separately as "confident" and "possible".

Each event has an upload quota and a per-guest upload limit. The quota depends on the package purchased. Deleting a post does not restore quota.

30 days after the event ends, the event and all its content are deleted automatically. Download the photos you want to keep within this period. After it, data cannot be recovered.

Creating an event requires credits. One credit corresponds to one event. Contact us for package and price information.

Used credits are non-refundable, without prejudice to force majeure (Section 11) and consumers' statutory rights. For credits purchased but not yet used to create an event, you may send us a refund request. Payments are collected by bank transfer; no card details are collected.

If you buy a package for non-commercial purposes (e.g. for your own wedding) you are a consumer: before payment you receive the Pre-Contract Information Form and Distance Service Contract (photonza.com/distance-sales), and your rights under Turkish Consumer Protection Law No. 6502, including the 14-day right of withdrawal, are reserved. Provisions of these Terms that are against consumers do not apply to you to the extent they conflict with that contract.

We work to provide the service without interruption but do not guarantee it. Maintenance, provider outages or force majeure (Section 11) may temporarily affect the service.

To the extent permitted by law, we are not liable for indirect damages or data loss. Our liability is in any case limited to the amount you paid for the event concerned. These limitations do not apply in cases of intent or gross negligence, or to consumers' statutory rights.

Do not keep the only copy of your photos on the platform. The platform is not a backup service and content is deleted at the end of the retention period.

Events beyond Photonza's control, such as natural disasters, epidemics, war, terrorism, strikes, cyber attacks, general outages of infrastructure providers and decisions of competent authorities, constitute force majeure; Photonza is not liable for failure to perform during that period. If force majeure lasts longer than 30 days, either party may terminate the contract and the price of unperformed credits is refunded.

Photonza may suspend or terminate an account or event in case of a breach of these Terms, the content rules or the law, a security threat, or a request from a competent authority. The reason and the route of objection are sent to the account email; objections are reviewed within 7 days at the latest. In serious breaches, such as content relating to the abuse of children or misuse of biometric data, no prior notice is given.

On termination for just cause, used credits are not refunded; the price of unused credits is refunded. Consumer organizers' rights under Turkish Consumer Protection Law No. 6502 and the Distance Service Contract are reserved.

To delete your account, write to info@alimertgulec.com. Your account, events and their content are removed; payment records are anonymised and kept for the statutory period. If you have a pending order, deletion takes place after the order is completed.

We may update these terms. The current version is always published on this page with its version and date.

Material changes affecting the price, the scope of data processing or the liability regime are notified to the account email at least 15 days before they take effect, and renewed acceptance is requested; renewed acceptance is collected with the mandatory acceptance checkbox in the event creation step of the first event you create after the change. An organizer who does not accept may terminate the contract free of charge and request a refund of unused credits. Corrections of spelling and wording take effect when published.

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes; consumers' right to apply to consumer arbitration committees and to the consumer courts where they live is reserved.

In disputes with an organizer acting as a merchant or tradesperson, Photonza's server, consent and transaction records constitute evidence under Article 193 of the Turkish Code of Civil Procedure (Law No. 6100); the right to submit counter-evidence is reserved. This clause does not apply to consumers.

The invalidity of one provision does not affect the others. In case of a transfer of the business, Photonza may assign this contract to the transferee by giving notice.
