Guest Participation Agreement

The parties to this agreement are Ali Mert Güleç, who operates the Photonza platform ("Photonza", "we"), and you, joining the event as a guest ("Guest", "you").

This agreement sets out the terms on which Photonza lets you join an event's shared photo feed, upload content, view and download content and, if you choose, find your own photos with face recognition.

• Organizer: The venue, event company, school, institution or photographer who created the event, shares the invite code and controls the event settings.
• Photographer: A professional connected to the event by the Organizer's invitation who uploads photos in bulk.
• Event: The space the Organizer creates on Photonza with its own invite code, PIN and photo feed.
• Content: Any photo, video, note or similar material uploaded to the event.

You join an event only with the QR code, invite code and PIN the Organizer gives you. You may share these only with people invited to the event.

You do not need an account, an email address or a phone number to join. You only enter a display name so other participants can recognise you. The name must not misleadingly present you as someone else.

You must be at least 18 years old to use Photonza. If you are under 18, you may join only with your parent's or guardian's knowledge and consent, and you may not use the face recognition feature.

You keep the copyright in the content you upload. You grant Photonza a free licence, limited to the event and the retention period, only to the extent needed to provide the service: to store, resize and display the content in the feed, to process it for face matching within the limits in Section 6 and to let participants download it. We do not use your content for advertising or marketing.

When uploading content you warrant that:

• You have the right to share the content.
• The people shown have no objection to sharing with event participants; for photos of children, the required parental consent has been obtained.
• The content is not illegal, obscene, violent, hateful, harassing or infringing on anyone's rights, and contains no material relating to the sexual abuse of children.

The Organizer may remove any content in their event. Photonza reviews infringements reported to it; if you breach these rules, Photonza reserves the right to remove content and end your access. How to request removal of content that shows you or infringes your rights: photonza.com/content-removal.

You can delete content you uploaded yourself at any time from within the app.

Photos you see and download in the event feed belong to other guests, the photographer or the organizer. You may use them only for personal, non-commercial purposes as a memory of the event.

You may not sell a photo, use it in advertising, share it in a way that demeans the people in it, or publicly distribute the image of a person who has not consented, without the owner's permission.

Photos uploaded by the photographer may be watermarked or download-restricted. Attempting to circumvent these restrictions is a breach of this agreement.

The following are also prohibited: automated data collection (scraping), bulk-download software and reverse engineering; impersonating another person, the organizer or Photonza; using face matching to identify or track people.

Buying a watermarked photo via "Buy" is a separate sales contract and is not formed by this agreement; if you buy as a consumer, the Pre-Contract Information Form and Distance Service Contract (photonza.com/distance-sales) are sent to you before payment.

Face recognition is optional and is not enabled by accepting this agreement. If you want to use it, you give explicit consent, based on a separate Biometric Data Notice, with a separate checkbox that is unticked by default, either when entering the event or before the selfie in "Find Me". If you do not consent, you keep using every other feature of the event.

In "Find Me" you may use only a selfie of your own face. Searching for another person's photos with their photo, a screenshot or a printed image of them is prohibited; in that case Photonza immediately deletes the face signature and results concerned, ends your access to the event, and you are liable for any resulting damage.

Your selfie never leaves your device; only a numeric face signature is sent to the server. Face matching is statistical and not perfect: some of your photos may not be found, or people who look like you may be suggested. Results are shown separately as "confident" and "possible".

You can delete your face signature and the face signatures stored because faces in event photos resemble you at any time from the Profile page ("Delete my face data"). They are also deleted when you leave the event.

You can access the event gallery without "Find Me": to the extent the event settings allow, you can view the photos in the feed and upload and download photos. Browsing the photographer's photos is on by default; if the photographer has turned it off, you can ask the organizer or the photographer for your photos.

Photos and videos shared in the event: In events where the Organizer keeps face recognition on, the faces in photos shared in the event and in frames sampled from videos are detected; the position of each face and a small face crop cut out of the photo are stored. The numeric signature of each face is computed only momentarily and compared with the selfie signatures of guests who have separately given explicit consent for "Find Me"; only the signatures of faces that resemble a consenting guest are stored, the others are discarded without being stored. The sole purpose is to let consenting guests find their own photos. This covers the people who appear in the photos you share and you when you appear in other people's photos. This data is not linked to any name, is not used for any other purpose, is not shared with anyone, and is deleted 30 days after the event ends or when the photo is deleted.

To object to this processing of your face and request deletion of the crop, position and any stored signatures, write to info@alimertgulec.com; details are in Section 4 of the Privacy Policy. This section is for information only: accepting this agreement does not mean giving explicit consent to the processing of your biometric data; explicit consent for "Find Me" is collected only via the separate checkbox.

30 days after the event ends, the event and all photos, videos, notes and face signatures in it are deleted automatically and irreversibly. Download the photos you want to keep within this period.

Photonza is not a backup or archive service. Do not keep the only copy of your photos on the platform.

You can end your participation at any time with "Leave event" on the Profile page. When you leave, your face signature is deleted; content you uploaded earlier stays in the feed unless you delete it.

The Organizer is responsible for the event's content, for whom they share the invite code with and for the event settings. Photonza is not obliged to pre-screen content uploaded by participants; it removes content when it receives an infringement notice.

The service is provided "as is". We do not guarantee uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect damages or data loss. The service is free for guests; our liability towards a guest is therefore limited to the mandatory statutory minimum.

How your personal data is processed is not the subject of this agreement; that information is in the Privacy Policy and Privacy Notice. Accepting this agreement does not mean giving explicit consent to the processing of your personal data. Consent for face recognition, the only processing that requires explicit consent, is collected separately.

We may update this agreement. The current version is always published on this page; when the version number changes you will be asked to accept it again the next time you enter an event.

This agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes. Guests participating as consumers keep their right to apply to consumer arbitration committees and consumer courts.
