Guest Participation Agreement

The parties to this agreement are Ali Mert Güleç, who operates the Photonza platform ("Photonza", "we"), and you, joining the event as a guest ("Guest", "you").

This agreement sets out the terms on which Photonza lets you join an event's shared photo feed, upload content, view and download content and, if you choose, find your own photos with face recognition.

• Organizer: The venue, event company, school, institution or photographer who created the event, shares the invite code and controls the event settings.
• Photographer: A professional connected to the event by the Organizer's invitation who uploads photos in bulk.
• Event: The space the Organizer creates on Photonza with its own invite code, PIN and photo feed.
• Content: Any photo, video, note or similar material uploaded to the event.

You join an event only with the QR code, invite code and PIN the Organizer gives you. You may share these only with people invited to the event.

You do not need an account, an email address or a phone number to join. You only enter a display name so other participants can recognise you. The name must not misleadingly present you as someone else.

You must be at least 18 years old to use Photonza. If you are under 18, you may join only with your parent's or guardian's knowledge and consent, and you may not use the face recognition feature.

You keep the copyright in the content you upload. You grant Photonza a free licence, limited to the event and the retention period, only to the extent needed to provide the service: to store, resize and display the content in the feed, to process it for face recognition and to let participants download it. We do not use your content for advertising or marketing.

When uploading content you warrant that:

• You have the right to share the content.
• The people shown have no objection to sharing with event participants; for photos of children, the required parental consent has been obtained.
• The content is not illegal, obscene, violent, hateful, harassing or infringing on anyone's rights.

Uploaded photos pass automated content moderation; inappropriate ones are rejected. The Organizer may remove any content in their event. If you breach these rules, Photonza reserves the right to remove content and end your access.

You can delete content you uploaded yourself at any time from within the app.

Photos you see and download in the event feed belong to other guests, the photographer or the organizer. You may use them only for personal, non-commercial purposes as a memory of the event.

You may not sell a photo, use it in advertising, share it in a way that demeans the people in it, or publicly distribute the image of a person who has not consented, without the owner's permission.

Photos uploaded by the photographer may be watermarked or download-restricted. Attempting to circumvent these restrictions is a breach of this agreement.

Face recognition is optional and is not enabled by accepting this agreement. When you want to use it, you are shown a separate Biometric Data Notice and a separate explicit-consent checkbox. If you do not consent, you keep using every other feature of the event.

Your selfie never leaves your device; only a numeric face signature is sent to the server. Face matching is statistical and not perfect: some of your photos may not be found, or people who look like you may be suggested. Results are shown separately as "confident" and "possible".

You can delete your face signature at any time from the Profile page. It is also deleted when you leave the event.

30 days after the event ends, the event and all photos, videos, notes and face signatures in it are deleted automatically and irreversibly. Download the photos you want to keep within this period.

Photonza is not a backup or archive service. Do not keep the only copy of your photos on the platform.

You can end your participation at any time with "Leave event" on the Profile page. When you leave, your face signature is deleted; content you uploaded earlier stays in the feed unless you delete it.

The Organizer is responsible for the event's content, for whom they share the invite code with and for the event settings. Photonza is not obliged to pre-screen content uploaded by participants; it removes content when it receives an infringement notice.

The service is provided "as is". We do not guarantee uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect damages or data loss. The service is free for guests; our liability towards a guest is therefore limited to the mandatory statutory minimum.

How your personal data is processed is not the subject of this agreement; that information is in the Privacy Policy and Privacy Notice. Accepting this agreement does not mean giving explicit consent to the processing of your personal data. Consent for face recognition, the only processing that requires explicit consent, is collected separately.

We may update this agreement. The current version is always published on this page; when the version number changes you will be asked to accept it again the next time you enter an event.

This agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes. Guests participating as consumers keep their right to apply to consumer arbitration committees and consumer courts.
